SWA Job Posting Services

SWA Job Posting Services ( State Work Force Agency ) are part of the required process. One that the Department of Labor requires employers to complete. Before they are able to bring over and employ a person from overseas for a position that is within the United States.

Each state has its own specific regulations for SWA Job Posting. They are typically located on their state workforce development page. In order to have a service complete this Job posting for you, they will need the following information:

Company address, job response contact, email & phone: While not typically displayed, this information is necessary. You need this information to register a sponsoring company.
FEIN Number and UIN Number, or Federal Employment Identification Number and Unemployment Insurance Number. You must provide these numbers, which may vary.

Job information, including things like Education, Training, Job Experience, and Salary and benefits when possible 

While not every state requires all of this information, some states will require you to fill out the exact salary amount before you can submit a job posting.

How do I Complete an SWA Job Posting?

Each state has its own State Work Force Agency (SWA), which requires employers to submit an ETA Form 9089.

Required info

  • Title of occupation
  • Skill Level
  • Wage source
  • The prevailing wage and applicable tracking number
  • SOC/ O* Net (OES) Code helps organize jobs into one of the 1000 categories that determine skill level, knowledge base, and tasks involved with a job. You can find the appropriate code online.
  • Dates of Determination and Expiration
You complete the SWA process by registering on one or more sites, properly documenting, tracking, and noting any Vet’s hold(s). This may also include tracking and noting the end of any Vets hold(s)**.
Once the prevailing wage is finalized, it usually remains valid for 90 days to a year. The employer must also keep documentation for 5 years.

** A Vets hold is a determination of  whether or not it may be appropriate to first train and hire a United  States  Veteran for the position</p>

What is a SWA Job Posting used for?

A SWA Job posting helps determine whether the salary or wage for a specific job is acceptable based on the location where the employer will hire the person. It verifies that the amount is appropriate for the requested job so that employers cannot try and pay a salary that is lower than appropriate.

If this sounds like it might be a time consuming and tedious process, It is ! but luckily if an employer is recruiting for multiple persons of the same job and skill levels this part of the PERM process only needs to be done once. Yay! However, be aware that the more generic job description is the more likely that there will be a larger number of applicants.

Why don’t all Immigration Advertising Agencies  Do SWA Job Posting Services?

Because of the detailed nature of these types of recruitment ads, the process of placings SWAs and accounting for all of the steps can be quite cumbersome and time-consuming.  However, because the financial incentive for SWA Jobs Postings is very small there are not very many company’s that do SWA Placement Services along with the rest of the Labor Certification Ad placement process.
