How to place a SWA Job Order as part of the PERM Process

The SWA Job Order is the first step in the PERM Labor Certification process. What is it? You must post a job on a state workforce agency board for 30 days. Why is it important? This posting gives U.S. workers a chance to apply before an employer hires a foreign worker. Who can help? My Classified Ads LLC has the reputation and experience to guide you through every step. Why trust anyone else with your SWA Job Order?

SWA Job Order: Key Requirements

Job orders must be posted for at least 30 consecutive days to comply with PERM requirements.

You need to end the posting at least 30 days before you file the PERM application.

You must provide your company’s Federal Employer Identification Number (FEIN), and, in some states (such as AL, CA, ID, MA, NY, NV, and UT), an Unemployment Insurance Number (UIN), as well as contact information.

This number can range in length from 5 to 9 digits. Also, different SWAs may refer to this number in different ways.

Placing job orders and employment ads often requires you to follow stringent advertising requirements. Attorneys and, in some cases, advertising agencies that specialize in job order placements, often handle the rest of the process.

All employers must place newspaper advertisements published on two separate Sundays. You must run these ads in a newspaper of general circulation in the area where the person will work.

Step-by-Step SWA Job Order Process

You need to include detailed descriptions of the job requirements in all job orders. List required education, training, and job experience. In some states, you must include salary information in the ad. Make sure your advertising complies with the state workforce agency in the state where the person will work. If the job is located in one state and your company is located in another, place the ad in the area of employment, not in your company’s area. You cannot complete electronic filing unless you specify all required details.

Salary & Benefits

Whenever possible, include the salary in all requests. Some states might not require it, but when they do, you cannot complete electronic filing unless you specify an actual number. While you are encouraged to mention benefits, you do not have to specify them.

  • Register your company on the appropriate state Workforce Agency portal.
  • Post the job order and make sure it is not under “veteran’s hold” or “pending approval,” so job seekers can view it.
  • Keep copies of the job order postings for your audit documentation.
  • Track and record all candidates the SWA refers as part of your recruitment process.
